Box that trapped drivers out of action after ruling

David Greene: legal challenge

A YELLOW box junction that earned the Town Hall £60,000 a month in fines could be axed after it was ruled illegal at a landmark hearing.
The box, at the busy junction of Southampton Row and Proctor Street, Holborn, is policed by CCTV cameras.
Drivers who stop on it face £100 fines under a Town Hall pilot scheme.
The box was reduced from 144ft to 88ft late last year after drivers said it was all but impossible to navigate without incurring fines in heavy traffic.
But now it has emerged that the new, smaller box may still be unlawful.
A motorist caught on the box has won a landmark victory at the Parking and Traffic Appeals Service after claiming its five-sided shape is illegal.
Lawyer David Greene, 48, spent hours researching the 1994 Road Traffic Act and found that regulations state a yellow box junction must have four sides.
The box at Holborn, even after being cut back, has five. A parking adjudicator has now ruled that the box is “unenforceable”.
Mr Greene said: “The yellow box junction should be got rid of now and every driver who has received a fine should get their money back.”
A Town Hall press official said the box would not be enforced by CCTV while guidance was sought on the law from the Department of Transport. She added: “We expect the advice will be imminent.”
n Town Hall workmen have finally moved a hidden sign banning U-turns in Southampton Row at the junction with Vernon Place.
Fines worth £250,000 were issued using CCTV in just 50 days to drivers who had failed to see the sign, which is now in a more prominent spot.
